Welcome to Tipoff Fantasy ("the App," "we," "our," or "us"). By creating an account or using the App in any way, you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree, do not create an account or use the App.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and Tipoff Fantasy. Your use of the App constitutes your full and unconditional acceptance of these Terms, our Privacy Policy, and any additional rules, guidelines, or policies we may publish from time to time. We reserve the right to modify these Terms at any time. Continued use after changes are posted constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years of age to create an account and use the App. By registering, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement. If you are under 18, you are prohibited from using the App. We reserve the right to terminate accounts of users we reasonably believe to be under 18.
3. Entertainment Purpose Only — No Real-Money Gambling
Tipoff Fantasy is a free-to-play fantasy sports entertainment platform. No real money, cryptocurrency, or items of monetary value are wagered, won, or lost through the App. The App does not constitute gambling, and no prizes of monetary value are awarded. Any in-app scoring, standings, or rankings are for entertainment and social competition purposes only. We make no representation that participation constitutes lawful activity in your jurisdiction, and it is your sole responsibility to determine whether your use of the App is lawful where you reside.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You are fully responsible for all activity that occurs under your account, whether or not authorized by you. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized account access. You may not create accounts using another person's identity, use false information, or transfer your account to any other person without our prior written consent.
5. User Conduct
You agree not to use the App to: (a) harass, abuse, threaten, defame, or harm any other user; (b) post or transmit obscene, offensive, or inappropriate content; (c) impersonate any person or entity; (d) engage in any fraudulent, deceptive, or manipulative conduct; (e) attempt to gain unauthorized access to any portion of the App or its related systems; (f) use bots, scripts, or automated tools to interact with the App; (g) violate any applicable local, state, national, or international law or regulation. We reserve the right to suspend or terminate your account for any violation of this section, at our sole discretion, without notice or liability.
6. Sports Data and Accuracy
The App may display sports statistics, scores, player data, standings, and other sports-related information sourced from third-party data providers. We make no warranties or representations regarding the accuracy, completeness, timeliness, or reliability of any sports data displayed in the App. Errors in data, scoring, or results may occur. We are not liable for any decisions made based on inaccurate or delayed data. Fantasy points, standings, and outcomes within the App may be subject to correction.
7. Intellectual Property
All content, features, branding, design, code, graphics, and user interfaces of the App are the exclusive property of Tipoff Fantasy and its licensors, protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial entertainment purposes only. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or exploit any portion of the App without our prior written consent. All team names, player names, and related sports content are the property of their respective owners; their use in the App is for entertainment reference only and does not imply endorsement.
8. Privacy and Data Collection
By using the App, you consent to the collection, storage, and use of your personal information as described in our Privacy Policy. We collect account information (name, email address), league activity data (draft picks, standings, chat messages), and usage analytics. This data is stored using Google Firebase services, subject to Google's data processing terms. We do not sell your personal information to third parties. We may use aggregate, anonymized data for product improvement and analytics.
9. User-Generated Content
Any content you submit through the App, including league names, display names, and chat messages ("User Content"), remains your property. By submitting User Content, you grant Tipoff Fantasy a worldwide, royalty-free, perpetual, irrevocable license to use, store, display, and distribute that content in connection with operating the App. You represent that your User Content does not infringe any third-party rights, is not unlawful, and does not violate these Terms. We reserve the right to remove any User Content at our sole discretion.
10. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED, ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, THAT IT WILL BE UNINTERRUPTED OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TIPOFF FANTASY AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED ONE HUNDRED DOLLARS ($100.00). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify, defend, and hold harmless Tipoff Fantasy and its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of another person or entity; or (d) any User Content you submit through the App.
13. Third-Party Services
The App integrates with third-party services including but not limited to Google Firebase (authentication and database), sports data providers, and web hosting services. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services. Links or integrations with third-party services do not constitute our endorsement of those services.
14. Service Availability and Modifications
We reserve the right to modify, suspend, or discontinue the App (or any portion thereof) at any time, with or without notice, and without liability to you. We may perform maintenance, updates, or changes that temporarily make the App unavailable. We do not guarantee any particular uptime or availability level. We are not liable for any loss or damage resulting from service interruptions or discontinuation.
15. Termination
We may suspend or terminate your account and access to the App at any time, for any reason or no reason, including violation of these Terms, without notice or liability. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination — including Sections 7, 10, 11, 12, 16, and 17 — shall survive.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall first be submitted to informal resolution by contacting us. If informal resolution fails, disputes shall be resolved by binding individual arbitration under the rules of the American Arbitration Association, conducted in Nevada. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tipoff Fantasy with respect to the App and supersede all prior agreements, representations, and understandings. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
